“国际视野下的数字时代与知识产权保护”法律论坛成功举办

2021年7月2日，“国际视野下的数字时代与知识产权保护”的法律论坛，于浩天信和律师事务所北京办公室11层成功举办。在知识产权国际合作和竞争并存的大背景下，本次论坛围绕网络平台数字版权作品保护、知识产权助力跨境企业在华经营、韩国、德国、美国的知识产权法律的最新发展、个人数据保护和知识产权运用等方面展开。本次论坛线上线下结合，邀请了韩国、德国、美国的知识产权专家、教授，对有关热点问题，进行了精彩的讨论。

On 2 July, 2021, the Legal Forum "Digital Era And Intellectual Property Protection From An International Perspective" was successfully held on the 11th at the Beijing Office of Hylands Law Firm. Under the background of international cooperation and competition of intellectual property, this forum focuses on protection of digital copyright works on the network platform, how intellectual property protection helps cross-border enterprises operate in China, the latest development on intellectual property system in South Korea, Germany and the United States, personal data protection and intellectual property rights. In this forum, experts and professors from South Korea, Germany and the United States of America were invited both online and offline to discuss the hot topics.

浩天信和律师事务所管委会成员、合伙人贾一鹏律师、韩国驻华使馆知识产权参赞金根模、美国卡多佐法学院副院长Valbona Myteberi作了开场致辞。贾律师表示，浩天信和律师事务所支持世界范围内的学术交流，对于一些目前社会中出现的新型问题，如数据安全、人脸识别等，他希望今后与各界进行深入交流。金参赞提到韩国企业在华最常见的问题之一是商标抢注，并期待在今天的会议上就此进行探讨。Myteberi教授在开场致辞后， 简要介绍了卡多佐法学院的法学教育体系和特点。

Mr. Jia Yipeng, Member of the Managing Committee and Partner of Hylands Law Firm, Mr. Kim Keunmo, Intellectual Property Attaché of the Korean Embassy in China, and Ms. Valbona Myteberi, Associate Dean of Yeshiva University Benjamin N. Cardozo School of Law have given opening remarks. Mr. Jia has said that Hylands Law Firm supports academic exchanges all over the world and shall discuss deeply on new issues in society, such as data security and face recognition. Mr. Kim has mentioned that one of the most common problems Korean enterprises face in China is trademark registration squatting, and he looks forward to discussing this at today's forum. After the opening remarks, Professor Myteberi has briefly introduced the education programs and characteristics of Yeshiva University Benjamin N. Cardozo School of Law.

美国卡多佐法学院教授Michael Burstein通过线上接入，以《美国商标法的最新发展》为题，做了精彩的演讲。首先，他分享了专利实体法的发展的信息，特别是合格主题原则专利适格主体原则。其次，他分享了一些关于专利诉讼的新发展，特别是与当事人之间的审查有关的。最后，他向我们介绍专利申请方面的最新进展，特别是美国专利商标局（PTO）正在采取的专利质量举措。

Michael Burstein, Professors of Yeshiva University Benjamin N. Cardozo School of Law gives a speech on “Recent Developments in U.S. Trademark Law” online. First, he shares information about developments in the substantive law of patents, specifically the eligible subject matter doctrine. Second, he shares information about new developments in patent litigation, particularly related to inter-party review. Then finally, he updates us on developments in patent prosecution, particularly the patent quality initiatives that are being undertaken in the United States Patent and Trademark Office or the PTO.

中国政法大学国际法治研究院副院长，海商法研究中心主任张丽英教授以《从新实施的<著作权法>谈网络平台数字版权作品的保护》为题，做了精彩的演讲。张教授从新旧《著作权法》的对比入手，介绍了当前网络相关知识产权的规定和网络平台数字版权业态及侵权特点。为了应对网络侵权案件取证困难的特性，出现了可信时间戳、区块链等新型取证手段。

Ms. Liying Zhang, Vice-President of the Institute of International Rule of Law, China University of Political Science and Law, Director of Maritime Law Research Center, has given a speech on “Discussion On The Protection Of Digital Copyright Works On Network Platform From The Newly Implemented Copyright Law”. Starting from the comparison between the new and old Copyright Law, Professor Zhang has introduced the current provisions of network related intellectual property rights and the characteristics of network platform digital copyright and the infringement. In order to deal with the difficulty of obtaining evidence in network infringement cases, new methods of obtaining evidence have emerged, such as trusted time stamps and block chain, etc.

浩天信和律师事务所合伙人董毅的演讲主题是《RCEP中的数字时代印迹》。董毅先生首先从RCEP（《区域全面经济伙伴关系协定》）的背景、历程、成员、总体结构等方面作了概括性介绍。董先生认为RCEP是一个与时俱新的协定，因为RCEP不仅涉及货物贸易、服务贸易和投资等方面，还纳入了知识产权、电子商务、政府采购、竞争等相对更“现代化”的议题，特别是知识产权、电子商务等章节，反映并适应了数字经济时代的发展需求。

Mr.Ian Dong, Partner of Hylands Law Firm has given a speech themed “Digital Era Imprint in RCEP”. Mr. Dong first gives a general introduction to RCEP (Regional Comprehensive Economic Partnership) from the aspects of its background, history, members and overall structure. Mr. Dong believes that RCEP is an agreement that keeps pace with the times, because RCEP not only involves product trade, service trade and investment, but also includes more "modern" topics such as intellectual property, e-commerce, government procurement and competition, especially the chapters on intellectual property and e-commerce, it reflects and adapts to the development needs of the digital economy era.

浩天信和律师事务所合伙人戴嘉鹏就《外国在华企业如何应对商标抢注》，发表了精彩演讲。戴律师首先介绍了国内商标的抢注乱象，遭抢注的不仅包括知名品牌，还有小众品牌、影视作品、热点事件、流行语等。随后，戴律师重点讲述了近年来热点外国商标在华抢注的几起案件，包括乔丹体育案、无印良品案、特斯拉案等。为了应对这种乱象，中国已重拳出击，从立法、执法、司法三方面对商标抢注予以治理。最后，戴律师为外国在华企业如何防范和应对商标抢注提出了全方位的建议。

Mr. Jiapeng Dai, Partner of Hylands Law Firm has talked about “How Foreign Enterprise In China Deal With Trademark Squatting”. Mr. Dai first introduces the chaos of trademark registration squatting in China. Not only well-known brands, but also minority brands, film and television works, hot topics, catchwords, etc are subject to registration squatting. Then, Mr. Dai focuses on several cases of foreign trademark registration squatting in China in recent years, including Jordan sports case, Muji case and Tesla case, etc. In order to deal with this chaos, China has made great efforts to deal with trademark registration squatting from 3 aspects: legislation, law enforcement and judicature. Finally, Mr. Dai put forward all-around suggestions for foreign enterprises in China on how to prevent and deal with trademark registration squatting.

As the last speaker in the morning, Ms. Yuzi Zhu, Partner of Hylands Law Firm has shared “Cross-Border Business Franchising” with the audiences. Firstly, Ms. Zhu gives a comprehensive introduction to the legal system of franchise, and lists a variety of modes of cross-border franchise. Then, Ms. Zhu talks about the issues on cross-border enterprise franchise from many aspects, including publicity and promotion, trade secrets, contract terms, dispute resolution, etc.

下午会议开始前，日本贸易振兴机构北京代表处知识产权部部长山本英一进行了开场致辞。在致辞中他简要介绍了日本贸易振兴机构以及知识产权部的具体工作，个人在中国的工作经历，并期待论坛圆满成功。

Before the speeches in the afternoon, Mr. Eiichi Yamamoto, Director of Intellectual Property Department, Beijing Representative Office of JETRO, gives an opening speech. In his speech, he has briefly introduced the specific work scope of JETRO, his personal working experience in China, and expressed his wish for the success of this forum.

随后，韩国互联网振兴院韩中互联网合作中心主任尹锡雄作了主题为《韩国个人信息保护法制动向》的演讲。尹主任首先简要介绍了韩国互联网振兴院，其次梳理了韩国个人信息保护方向的立法体系及内容，特别是欧洲GDPR立法出台前后韩国相关立法的变化。尹主任随后还介绍了韩国近些年对个人信息保护方面出台的一些举措，并总结韩国下一步的个人信息保护的方向是利用和保护并行、均衡发展。

Later, Mr. Yoon, Seokung, Director of Korea-China Internet Cooperation Center, Korea Internet Promotion Institute, speaks on "The Legal Direction Of Personal Information Protection In South Korea". Mr. Yoon first briefly introduces Korea Internet Promotion Institute, and then talks about the legislative system and content of Korean personal information protection, especially the changes of the relevant laws in South Korea before and after the introduction of European GDPR. Mr. Yoon also introduces some measures of personal information protection in South Korea in recent years, and summarizes that the trend of personal information protection in South Korea will be the parallel and balanced development of utilization and protection.

韩国中央大学法学院教授、中央大学文化、媒体和娱乐法研究所所长李圭镐通过线上接入，作了主题为《韩国知识产权法上的增额赔偿制度》的精彩分享。具体介绍了韩国近年通过立法通过的知识产权领域的知识产权侵权三倍赔偿制度，特别是在专利和商业秘密领域。

Mr. Gyooho Lee, Professor of Law School of Chung-Ang University, Director of the Culture, Media and Entertainment Law Research Institute has joined this forum online and given a speech on “Increased Damages In Korean Intellectual Property Laws”. He introduces the new treble compensation system of intellectual property right infringement in the field of intellectual property, especially in the fields of patents and trade secrets, which has been passed in South Korea in recent years.

Ms. Wei He, Partner of Hylands Law Firm has delivered a speech themed “Discussion On The Key Points Of Privacy Protection And Compliance For Internet Companies”. Ms. He firstly talks about the process of privacy protection legislation from the perspective of supervision, the supervision means adopted by different administrative departments, and the legal responsibilities of personal information processors. Secondly, Ms. He introduces in details on the key points of enterprise privacy protection compliance from 5 aspects: personal information collection, storage, use, circulation and disclosure. Finally, Ms. He provides specific suggestions on how to build a privacy protection compliance system.

中国政法大学韩国法研究中心主任，韩日涉外法律专家，吴日焕教授进行了《我国个人数据跨境移转的法律规制现状与企业的应对》的主题演讲。他首先介绍了跨境数据流动的发展现状与规制背景。其次，他从中国现有个人数据保护法律立法的角度，对目前规制的亮点进行了讲解。最后，吴教授针对《个人信息保护法》框架下的企业对于个人信息出境的应对，企业如何管理其存储的用户个人数据，如何与监管机构配合，及如何与外部机构合作提出了建议。

Mr. Rihuan Wu, Professor of China University of Political Science and Law, expert of Foreign (Korean and Japanese) Law has given a speech themed “The Status Quo Of Legal Regulation Of Cross-Border Transfer Of Personal Data In China And The Countermeasures Of Enterprises”. He first introduces the updated status and regulatory background of cross-border data flow. Secondly, he mentions the important parts of the current legislation and regulations on the legal system of personal data protection. Finally, Professor Wu gives some suggestions on how enterprises should respond to the export of personal information under the framework of Personal Information Protection Law, how enterprises should manage their stored user personal data, how to cooperate with regulatory agencies, and how to cooperate with external agencies.

浩天信和律师事务所合伙人田劼在会上进行了以《从企业刑事合规视角看个人信息保护》为主题的分享。田律师先就公安机关侦办侵犯公民个人信息案件情况进行了介绍。随后，她结合个人信息保护的刑事相关法律法规，就《民法典》对个人信息保护的明确要求进行了探讨。田律师还分享了个人信息处理全生命周期涉刑案例，并在最后就如何防范企业处理个人信息的刑事风险提出了建设性的建议。

Ms. Jie Tian, Partner of Hylands Law Firm speaks on “Personal Information Protection From The Perspective Of Corporate Criminal Compliance”. Ms. Tian talks about the cases of infringing citizens' personal information investigated and dealt with by Public Security Bureau. Then, combining with the relevant criminal laws and regulations of personal information protection, she discusses the requirements of Civil Code for personal information protection. Ms. Tian has also shared the whole process of criminal cases of personal information processing, and finally put forward useful suggestions on how to prevent the criminal risk of enterprise processing personal information.

He has further shared the relevant provisions of German trademark and name law, and introduced the corresponding cases, litigation proceedings and measures.
