浩天合伙人刘京律师受邀为新加坡工商联合总会（SBF）进行中国法律培训

新加坡工商联合总会（Singapore Business Federation）是新加坡贸易和工业部（Ministry of Trade and Industry )下辖的政府机构，它被新加坡政府定义为支持新加坡商界在贸易、投资和劳资关系领域利益的最高商会。它代表了超过29,000家公司及主要的本地和外国商会组织。新加坡政府于2002年4月通过法令，确认了新加坡注册的公司，如注册/实缴资本等于或超过50万新币，则自动成为SBF的法定成员，每年需缴纳相应会费。SBF综合考虑了会员企业的需求，特邀请浩天律师事务所合伙人刘京律师为会员企业讲授《中国的外商投资政策》和《中国的劳动法及相关规定》。

The Singapore Business Federation (SBF) is a section affiliated to the Ministry of Trade and Industry, a state organ of Singaporean government. SBF is defined as the apex business chamber championing the interests of the Singapore business community in the areas of trade, investment and industrial relations. It represents more than 29,000 companies, as well as key local and foreign business chambers.The Singapore government passed an ordinance in April 2002, confirming that Singapore-registered companies, such as registered/paid-up capital equal to or exceeding SGD 500,000, automatically become statutory members of SBF and need to pay corresponding membership fees annually. It was noted that SBF cordially and humbly invited Mr. Michael Liu, a senior partner of Hylands Law firm to grant them a lecture on Foreign Investment Policy in China and a lecture on Chinese Labour Law and Relevant Provisions.

刘京律师于13日上午进行了以《中国的外商投资政策》为题的主题演讲。首先，刘京律师为能受到邀请并作为本次主题课程的主讲人表达了对SBF和新加坡KC  Partnership律师事务所的感谢。随后，刘京律师简要介绍了其工作的北京浩天律师事务所。本次关于《中国的外商投资政策》的主题课程主要从以下几个方面展开：1.中国的外商投资环境；2.中国外商投资的三种形式；3.三种不同投资形式的优缺点；4.外商进入中国可能面临的诉讼仲裁问题。刘京律师先简要阐述了目前中国的外商投资环境，其次用具体案例生动形象地讲述了中国外商投资的三种不同形式，分析这三种形式的优缺点，然后说明了国内诉讼和仲裁制度，启发了大家针对外商在中国如何制定争议解决策略的思考。最后，刘京律师简要总结外商投资中国时可能遇到的法律问题，并结合自己丰富的经验给出了真切的建议。

On the morning of October 13th, Michael gave a workshop speech on Foreign Investment Policy in China. Firstly, Michael expressed his gratitude to SBF and KC Partnership in Singapore for being invited as the speaker of these themed workshops. Then, Michael briefly introduced the law firm where he works, Hylands Law Firm. This workshop on the Foreign Investment Policies in China has focused on the following aspects: 1. The foreign investment environment in China; 2. The 3 forms of foreign investment in China; 3. The advantages and disadvantages of these 3 forms; 4. Litigation and arbitration issues that foreign investors may face when entering China. Michael first briefly introduced the present foreign investment environment in China, then vividly described 3 different forms of foreign investment in China with specific cases, analyzed the advantages and disadvantages of these 3 forms, which inspired participants to think about how foreign investors should formulate dispute resolution strategies in China. Finally, Michael briefly summarized the legal problems that foreign investors may encounter when they invest in China, and gave some practical suggestions according to his rich experience.

13日下午，刘京律师进行了以《中国的劳动法及相关规定》为题的主题演讲。首先，刘京律师简要介绍了中国关于劳动问题的相关法律规定，着重介绍了《劳动法》的修改背景和新修亮点。其次，刘京律师重点阐述了中国的《劳动法》和《劳动合同法》关于劳动关系、劳动合同的订立与履行、劳动合同的终止、经济补偿金、社会保险、劳动纠纷解决等问题。最后，刘京律师从自己的实践经验出发，向参加课程的各位律师和企业代表介绍了中国“劳动纠纷仲裁前置”的劳动争议的解决方式，并分享了自己对于不同类型劳动争议的见解。

On the afternoon of the October 13th, Michael gave another workshop speech on Chinese Labour Law and Relevant Provisions. Firstly, Michael briefly introduced the relevant labour laws and regulations in China, focusing on the background and highlights of the revision of the PRC Labour Law. Secondly, Michael focused on China's Labour Law and Labour Contract Law on labour relationship, the conclusion and performance of labour contracts, the termination of labour contracts, severance pay, social insurance, and labor dispute resolution. Finally, based on his own practical experience, Michael introduced the resolution methods of labour disputes in China's "Labour arbitration is a pre-procedure for labour litigation" to the lawyers and enterprise representatives participating in the workshop, and shared his insights on different types of labour disputes.
