打击侵犯知识产权和制售假冒伪劣商品行为

全国打击侵权假冒工作领导小组是我国打击侵权假冒工作的领导机构，其办公室设在国家市场监督总局，由国务委员王勇担任组长，市场监管总局局长张茅、国务院副秘书长孟扬担任副组长，市场监管总局、知识产权局等为其成员单位。

National Leading Group on Fight against IPR Infringement and Counterfeiting is a leading institution of work of national crackdown on IPR Infringements and Counterfeits, its office is set up in State Administration for Market Regulation, the State Councilor Wang Yong is the group leader, the Director of the State Administration for Market Regulation Zhang Mao and Deputy Secretary-General of the State Council Meng Yang are the deputy leaders, State Administration for Market Regulation and National Intellectual Property Administration etc. are its member entities. 

为了全面做好2019年全国打击侵犯知识产权和销售假冒伪劣商品工作，全国打击侵权假冒工作领导小组于2019年6月11日发布了《2019年全国打击侵犯知识产权和制售假冒伪劣商品工作要点》（以下简称“《工作要点》”），总结了目前需要面对的突出问题，提出了解决建议，并动员各方力量共同打击不法行为。

In order to comprehensively carry out the national campaign against Intellectual Property Rights (hereinafter “IPR”) infringements and counterfeit products of 2019, the National Leading Group on Fight against IPR Infringement and Counterfeiting issued the Main Points of Campaign against Intellectual Property Rights infringements and counterfeit products of 2019 (hereinafter “Main Points”) on June 11, 2019. The Main Points have concluded the current outstanding problems and come up with suggestions for solving these problems, this Main Points also mobilize the whole forces to fight against illegal acts jointly.

《工作要点》指出，目前工作焦点应集中在四个方面：

The Main Points pointed out that current work shall focus on the following four aspects:

（一）互联网领域侵权假冒治理。严厉打击在线销售侵权产品，加大网络影视、音乐等领域版权监管，强化互联网企业监管，完善违法违规网站处置流程，净化网络环境，切实保护相关主体的知识产权。

Governance of infringement and counterfeit in the Internet field. Strictly crack down on online sales of infringing products, strengthen the supervision of copyrights in the fields of online television and music. In addition, strengthen the supervision of enterprises carry out business on Internet, improve the disposal process of illegal websites, purify the network environment, and effectively protect the relevant subjects of IPR.

（二）农村和城乡结合部市场治理。将农村和城乡结合部视为知识产权保护的重点范围，针对食品、药品、小家电、农资品等，打击制售侵权和假劣产品等违法违规产品的行为，加大城市外知识产权的保护力度。

 Governance of markets in rural and urban-rural integration area. Consider rural and urban-rural integration area as the important field of IPR protection, fight against acts of producing counterfeit products, products infringe other people’s IPR, or other illegal products in field of food, medicine, small household appliances and agricultural materials, etc., strengthen the protection of IPR outside cities.

（三）统筹进出口环节侵权假冒治理。严厉打击跨境违法犯罪行为，强化高风险货物和重点航线监控，加强知识产权海关保护，减少跨境产品侵害知识产权的可能性。

 Coordinate the management infringement and counterfeiting of import and export links. Strictly crack down on cross-border criminal acts, strengthen the supervision of high-risk goods and key routes of transportation, strengthen protection of intellectual property rights given by Customs, and reduce the possibility of cross-border products’ infringing IPR.

（四）完善外商投资企业知识产权保护。着力解决知识产权领域不正当竞争、专利侵权假冒产品和盗版侵权等问题，加大知识产权的保护力度，减少外商投资顾虑，促进经济发展。

 Improve the IPR protection of foreign-invested enterprises. Make efforts to settle problems about unfair competition in the IPR field, infringement of patent right and counterfeit products, strengthen the protection of IPR, and reduce the concerns of foreign investor in order to promote economic development.

针对四个方面的主要问题，《工作要点》也给出了相应的解决建议：对内坚持依法行政，强化知识产权的司法保护；对外深化与各国家和国际组织的对外合作，加强跨境执法协作，同时大力支持企业开展海外维权。

In order to solve the problems in these four fields, the Main Points have also come up with some suggestions accordingly. At internal dimension, we should stick to the principle of administration by law, strengthen the jurisdictional protection of IPR. At external dimension, we should deepen the cooperation with other states and international organizations, further coordinate the cross-border law enforcement activities and support overseas enterprises protect their IPR.

目前，知识产权保护需求日益增长，国家也越来越重视知识产权保护，我国迎来了保护知识产权的好时机。在这样的背景下，如果知识产权遭受到了不法侵害，权利人更应当拿起法律武器，依据我国相关法律规定保护自己的合法权益。

At present, the demand for IPR protection is growing day by day, and the state has paying more and more attention to the IPR protection, China now has a good opportunity to protect IPR. In this scenario, if IPR are unlawfully infringed, the right owners shall protect their legitimate rights and interests in accordance with the relevant Chinese laws and regulations.
